About these terms
These terms cover the websites at sunpebblelabs.com and sunpebble.github.io and the apps and related services provided by Sunpebble, LLC ("Sunpebble," "we," or "us"). By using these services, you agree to these terms. If you do not agree, do not use the services.
An app may have its own license or additional terms presented with it. Those terms govern that app where they differ from this page. Nothing here limits rights that applicable law does not allow us to limit.
Using our services
Use our services only where permitted by applicable law and the terms that apply to you. If you cannot enter into these terms on your own under the laws where you live, a parent or legal guardian must review and agree to them with you.
Where an app offers an account, provide accurate information and keep your sign-in details secure. Tell us if you believe someone has accessed your account without permission. Some apps work without an account; these account requirements apply only when you use one.
- Do not use the services for unlawful activity or to infringe another person's rights.
- Do not access accounts, devices, databases, or data without authorization.
- Do not distribute malicious code, interfere with security, or deliberately disrupt the services.
- Do not bypass payment or access restrictions, except where applicable law expressly permits it.
App licenses and ownership
Our software, designs, text, and brand assets belong to Sunpebble or their respective owners. Using the services does not transfer ownership of them to you. Subject to these terms and any applicable app license, you may use the services for their intended purposes.
Apps obtained through the App Store are subject toApple's Standard End User License Agreementunless a separate app license is provided. These service terms do not replace that license.
For software distributed with an open-source or other separate license, that license governs your use, copying, modification, and distribution of the software. These terms do not remove permissions granted by those licenses.
Purchases and subscriptions
If an app offers paid features, the price, billing period, trial conditions, and renewal terms are shown before you purchase. Subscriptions renew as described at purchase unless canceled through the provider that bills you. A free download does not mean every feature is free.
Apple handles payments for purchases made through the App Store. You can manage or cancel those subscriptions through your Apple Account; seeApple's cancellation instructions. Deleting an app or an app account is not a substitute for canceling a subscription.
For App Store purchases, use Apple's refund process. Eligibility depends on the purchase, the store's policies, and applicable law. For purchases through another provider, follow the terms and support process shown at checkout. Nothing in these terms removes any statutory refund or cancellation rights.
Your content and privacy
You retain ownership of the content and data you add to our apps. You must have the right to use that content and to share it with anyone you invite. When a feature needs us to store or process your content, you authorize us to do so only as needed to provide that feature and as described in the applicable privacy policy.
Our Privacy Policy explains the website's data practices and links to each app's policy. Storage, sync, sharing, and deletion vary by app; using these services does not give us ownership of your content.
Keep backups of important data. Review edits, exports, and deletions before confirming them, especially when using tools that change your files or databases.
Information and generated suggestions
Our apps are tools to help you organize information and make plans. Health-related records and summaries are for personal tracking and are not medical advice, diagnosis, or treatment. Do not use them as a substitute for a qualified healthcare professional or an emergency service.
AI-generated plans and other suggestions may be incomplete, inaccurate, or out of date. Check important details, such as travel requirements, opening hours, prices, and availability, with the relevant provider before relying on them or making a booking.
Third-party services
Some features depend on services operated by others, such as app stores, cloud storage, maps, media providers, or AI services. Their own terms and privacy policies apply when you use them. We do not control their content, availability, or changes to their services.
Availability and changes
We may update features, fix errors, or change supported devices and integrations. Services may be unavailable during maintenance or because of failures beyond our control. We do not guarantee that every feature will always be available or work without errors.
If we discontinue a paid service or make a material change affecting an existing purchase, we will provide notice and any remedies required by applicable law or the terms of that purchase.
Ending use or restricting access
You may stop using the services at any time. If an app offers an account, use its deletion controls or contact us for help. Cancel any paid subscription separately with your billing provider.
We may restrict access to hosted services when reasonably necessary to address a material breach of these terms, a security risk, or a legal requirement. Where reasonably possible, we will explain the reason and give you an opportunity to resolve the issue. You can contact us if you believe a restriction was made in error. Separate software licenses remain governed by their own termination provisions.
Warranties and responsibility
Except for commitments expressly made for a service and rights required by law, the services are provided on an "as is" and "as available" basis. To the extent permitted by law, we do not provide implied warranties of fitness for a particular purpose or uninterrupted operation.
To the extent permitted by law, Sunpebble is not responsible for indirect or consequential losses arising from your use of the services. This does not exclude or limit liability for fraud, willful misconduct, or any other liability that cannot lawfully be excluded or limited, and does not affect mandatory consumer protections.
Changes to these terms
We will post updates on this page with a new effective date. For material changes affecting an ongoing service, we will provide additional notice where required and obtain your consent where the law requires it. Changes will not apply retroactively to disputes that arose before the change took effect.
